We therefore count as average 5 business days — or working days — in a work week. Of course, some people may work during week-end days or public holidays but that is not the majority. And they will be paid holidays. In the private sector, things are more complicated. Only Massachusetts and Rhode Island have provisions that say employees must get these days off with pay. Public employers generally have to grant employees paid leave. On all or at least some public holidays. Or give them extra pay for coming in on these days. But in practice they face liability for direct discrimination. Employers with 15 or more employees must make reasonable accommodations for religious observances.
